Yabble Acceptable Data Policy

BY ACCEPTING THIS AGREEMENT, EITHER BY CLICKING A BOX INDICATING YOUR ACCEPTANCE, EXECUTING A SERVICE ORDER OR OTHER DOCUMENT THAT REFERENCES THIS AGREEMENT, BY USING (OR MAKING ANY PAYMENT FOR) THE APPLICATION OR SERVICES, OR BY OTHERWISE AFFIRMATIVELY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT, YOU: (i) AGREE TO THIS AGREEMENT ON BEHALF OF CUSTOMER; AND (ii) REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND CUSTOMER TO THIS AGREEMENT. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU (OR CUSTOMER) DO NOT AGREE WITH THIS AGREEMENT, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE APPLICATION OR SERVICES.

Definitions

Customer Data” means any data that is uploaded to the Application by a Customer or its Authorized Users, or created by Customer or its Authorized Users using the Application.

Personal Data” means and includes “personal data,” “personal information,” and “personally identifiable information,” and such terms shall have the same meaning as defined by the New Zealand Privacy Act 2020 or other applicable law.

“Úser” means the registered company or individual licensed to use the Yabble software.

Terms of Use

  1. Where Personal or Customer Data is uploaded by the User, the User confirms they have all legal rights to use this data for the purpose of research and analysis.   If the user does not have this permission, data may not be uploaded.
  2. Yabble strongly recommends that no Personal Data is uploaded into the Yabble Application.  
  3. Yabble prohibit Users from knowingly generating—or allowing others to knowingly generate—the following categories of content:
  • Hate: content that expresses, incites, or promotes hate based on identity.
  • Harassment: content that intends to harass, threaten, or bully an individual.
  • Violence: content that promotes or glorifies violence or celebrates the suffering or humiliation of others.
  • Self-harm: content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders.
  • Sexual: content meant to arouse sexual excitement, such as the description of sexual activity, or that promotes sexual services (excluding sex education and wellness).
  • Political: content attempting to influence the political process or to be used for campaigning purposes.
  • Medical: content attempting to provide medical diagnosis or to be used for medical recommendation purposes
  • Spam: unsolicited bulk content.
  • Deception: content that is false or misleading, such as attempting to defraud individuals or spread disinformation.
  • Malware: content that attempts to generate ransomware, keyloggers, viruses, or other software intended to impose some level of harm.
